Warranty Declaration
General Information
At Hold My Bike, we pride ourselves on using high-quality, european sourced, materials in all our products. This ensures not only an excellent user experience but also long-lasting durability. However, despite rigorous quality controls and testing, there may be instances where a product develops a fault. In such cases, we offer the following manufacturer’s warranty in addition to the statutory warranty that applies between the consumer and the seller.
Hold My Bike FlexCo, Simmelgasse 1/3/25, 1210 Vienna, Austria, offers a time-limited warranty on the products it manufactures under the following terms and conditions. This warranty is granted without prejudice to mandatory statutory liability provisions, such as the Product Liability Act, in cases of intent, gross negligence, or injury to life, body, or health caused by Hold My Bike or its agents.
A consumer, for the purposes of this manufacturer’s warranty, is any natural person who owns the product and did not acquire it with the intention of reselling it privately or as part of a commercial or self-employed activity.
Warranty Coverage
The warranty applies exclusively within the European Union. It covers all products purchased from the date the warranty was introduced (proof of purchase required). Hold My Bike guarantees that your products are free from manufacturing defects. Any claims under product liability will be governed by statutory provisions. Under this warranty, defects proven to be due to material faults will be rectified.
The warranty period for all products is 1 year from the purchase date. If the product is found to be faulty at the time of delivery, you must notify our support team immediately upon receipt of the goods. We will arrange for a replacement to be sent.
Defects that occur after the product has been used can be reported through our claims form. Products that are more than 1 year old are generally excluded from the warranty. Under this warranty, defects due to material faults will be rectified free of charge by replacing the product, potentially with a newer model or a different colour.
Each product can only be claimed once per order and model. For example, if a customer orders different models of bike mounts and claims both within 1 year, they are covered by the warranty.
Duplicate entries for the same product from a single order number in our claims form cannot be processed. Hold My Bike reserves the right to offer a refund or partial refund of the purchase price as an alternative.
The services described here are in addition to the statutory warranties and do not replace or limit them. This warranty is a voluntary service provided by Hold My Bike, which may be refused without giving reasons.
Exclusions from the Warranty
Goodwill and Gifts: There is no entitlement to warranty coverage for gifts or goodwill gestures. A valid purchase must be made in exchange for the warranty to apply.
Third-Party Purchases: Purchases of Hold My Bike products from third-party sellers are not eligible for warranty coverage.
Products Obtained via Promotions: If products were gifted as part of a promotion or trial, no warranty applies.
Products Older Than 1 year: Products purchased more than 1 year ago are not covered by the warranty.
Replacement of a Replacement Product
A warranty claim for a product that was already replaced under warranty is only valid if the claim is made within 1 year of the original purchase.
Making a Warranty Claim
To make a warranty claim, customers must fill out the provided claims form. After receiving the form, customers will be informed of the next steps in the claims process. Returns are free within the EU in the case of a valid warranty claim.
Making a Claim on Behalf of a Gift Recipient
If a product is gifted (e.g., Customer 1 purchases a product and gifts it to Customer 2, and Customer 2 makes the claim), the warranty claim can only be processed if Customer 2 has all relevant purchase details from Customer 1 (e.g., email, order number, name, shipping address). These details must be provided exactly as they appear on the original purchase.
Documentation Requirement
A warranty claim will only be valid if clear photos are provided by the customer. Clear identification includes the visible Hold My Bike logo, the model, and the colour of the product, along with clear evidence of the defect.
Note on Warranty Assurance Under Austrian Law
Independently of this manufacturer’s warranty, consumers retain their full statutory warranty rights against the respective seller. Even without making a warranty claim, consumers can exercise their legally regulated rights for defective goods, including repair, replacement, reduction of the purchase price, or compensation (as per §§ 922 to 933 ABGB and the Austrian Consumer Protection Act) within the corresponding statute of limitations.
Liability
This warranty does not cover claims for consequential damages of any kind or other claims for compensation. This limitation does not apply in cases where the manufacturer is legally liable beyond the scope of this voluntary warranty.
Exclusion Period and Expiration
Warranty claims must be made immediately, but no later than two months after discovering a defect. After this period, no claims can be made under the warranty. Warranty claims expire six months after the end of the warranty period.
